Agreement to Terms

By downloading, accessing, or using the ClockInOut mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and ClockInOut ("we," "us," or "our") regarding your use of the App and its services.

License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems or services

Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Use the App only if you are 18 years of age or older

Premium Subscriptions

Available Subscription Plans

ClockInOut Premium is available through the following subscription options:

• Weekly Premium: Billed weekly, auto-renews every 7 days
• Monthly Premium: Billed monthly, auto-renews every 30 days
• Yearly Premium: Billed annually, auto-renews every 365 days
• Lifetime Premium: One-time purchase, no recurring billing

Premium Features

Premium subscriptions unlock:

• PDF Export: Generate professional timesheet reports
• Advanced Analytics: Detailed charts, statistics, and earnings tracking
• Cloud Sync: Automatic synchronization across all your devices

Pricing

Subscription prices are displayed in the App and may vary by region based on your local currency. Prices are subject to change with notice. You will be charged the price shown at the time of purchase.

Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal will be charged at the same price as the original subscription, unless the price has changed and you were notified
• You can manage or cancel your subscription through your Apple ID account settings at any time
• Cancellation takes effect at the end of the current billing period

Free Trials

We may offer free trial periods for new subscribers. If you start a free trial:

• You must cancel before the trial period ends to avoid being charged
• If not cancelled, your subscription will automatically begin and you will be charged
• You may only use one free trial per Apple ID account
• Unused portions of free trials are forfeited upon purchase of a subscription

Payment Processing

All payments are processed through the Apple App Store. Your purchase will be charged to your Apple ID account. We do not have access to your payment information.

Cancellation and Refunds

How to Cancel

To cancel your subscription:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select ClockInOut Premium
5. Tap "Cancel Subscription"

You will continue to have access to premium features until the end of your current billing period.

Refund Policy

Refunds are handled by Apple according to their refund policies. To request a refund:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find your ClockInOut purchase
4. Select "Report a Problem" and follow the instructions

We cannot process refunds directly. All refund requests must go through Apple.

Lifetime Purchase

The Lifetime Premium purchase is a one-time, non-recurring payment that provides permanent access to premium features. This purchase is non-refundable except as required by law or Apple's refund policy.

User Content and Data

You retain ownership of all data you input into the App, including:

• Clock-in and clock-out times
• Break/lunch duration records
• Hourly rate information
• Shift notes and details

You are responsible for maintaining backup copies of your data. While we implement cloud synchronization for premium users, we are not liable for any data loss.

Acceptable Use

You agree not to:

• Use the App to violate any laws or regulations
• Attempt to interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Impersonate others or misrepresent your identity
• Share your account credentials with others
• Use the App in any way that could damage our reputation

Intellectual Property

The App and its content (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by ClockInOut and protected by copyright, trademark, and other intellectual property laws.

"ClockInOut" and related logos are trademarks of ClockInOut. You may not use these marks without our prior written permission.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of time tracking data

You are solely responsible for verifying the accuracy of time records and complying with applicable labor laws and employer requirements.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOCKINOUT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or other intangible losses
• Damages resulting from unauthorized access to your account
• Damages resulting from errors, inaccuracies, or omissions in time tracking
• Damages from employment disputes related to time records

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold ClockInOut harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any disputes with your employer regarding time records

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your account remains inactive for an extended period
• We discontinue the App or service

You may delete your account at any time through the App settings. Upon deletion, your data will be permanently removed within 30 days.

Changes to the App

We reserve the right to:

• Modify, suspend, or discontinue the App (or any features) at any time
• Change subscription pricing with 30 days' notice to existing subscribers
• Update the App to fix bugs, improve performance, or add features
• Require updates to continue using the App

Changes to Terms

We may update these Terms periodically. We will notify you of significant changes through:

• In-app notifications
• Email (if you provided an email address)
• Updated "Last Updated" date at the top of this page

Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.

Apple App Store Terms

This App is made available through the Apple App Store. You acknowledge and agree that:

• These Terms are between you and ClockInOut, not Apple
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for the App or its content
• Apple is not liable for any claims related to the App
• You must comply with Apple's App Store Terms of Service
• Apple is a third-party beneficiary of these Terms and may enforce them

Governing Law

These Terms are governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable consumer protection laws.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
